Privacy policy

This policy sets out the terms and conditions regarding the privacy of visitors to the Réseau express métropolitain (REM) Website and the manner in which visitors’ personal information is used, processed and transmitted.

By deciding to use the REM website, the visitor accepts the practices of the REM project office with respect to the processing and protection of their personal information (hereinafter the "Policy"). In particular, the visitor agrees to the collection and use of his or her personal information by the REM in accordance with the Policy, on the understanding that it complies with its personal information legislation.

The visitor agrees and acknowledges that the REM reserves the right, at any time, to modify, change or update the policy, and the visitor agrees to be bound by such amendments, changes or updates. The use of the Site by the visitor after such a modification is an agreement of the visitor to accept the amended policy and be bound by it. It is up to the visitor to learn about any changes to the policy. If the visitor does not accept this Policy, or, as the case may be, the Policy as amended from time to time, he shall not use the Site.

Electronic Personal Information

By accessing the Site, the visitor acknowledges and agrees that an exchange of information may take place automatically between the visitor's computer and the REM server. This exchange of information allows REM to obtain the Internet domain name that the visitor used to access the Site, the visitor's IP address, the browser type and operating system used by the visitor to access the site, the date and time the visitor accessed the Site, pages visited by the visitor, and, if the visitor reaches the Site from another site, the address of the referring site.

It is through cookies that the Site's operating system may automatically collect this information regarding the visitor's visit to the Site. Cookies are small pieces of information stored by your browser on your computer's hard drive, which allow the REM to recognize the visitor when accessing the Site. When the visitor browses the Internet, cookies are used for the purposes described above.

If the visitor does not wish information about his visit to be collected by the REM, he may, at his discretion, configure his browser to warn him when he receives a cookie or to prevent such cookies from being sent.

This information is used by REM to measure the number of visits by visitors to the Site as well as on the different pages which they view, the average time visitors spend on the Site and to establish other statistics regarding site visits in general. This information allows also the REM to monitor site performance, for systems administration purposes, to make the Site easier and more convenient to use and to relay certain overall processed information to Representatives for whom the transmission of such information is necessary to perform their duties. 
 

Other Personal Information

The REM only collects other personal information about the visitor only if the visitor, at his or her sole discretion, decides to provide such information voluntarily. However, if the visitor wishes to receive REM information or to subscribe to an REM mailing list, he / she must disclose his / her e-mail address so the REM server may respond to his / her request or send the requested information. This information is also gathered so as to enable and manage subscriptions to the REM mailing list (including, but not limited to, changing its subscription settings and deleting its mailing list name), to facilitate communication of relevant information to visitors and for better knowledge of their profiles. This information is strictly confidential and will not be used for commercial purposes.

A copy of the personal information the Visitor provides to REM and which REM retains is kept on REM's servers. Visitors may access the personal information provided to REM and may notify REM to update, change or delete information collected by REM during his visit, by sending an Email to [email protected] or by responding to messages sent to him through his subscription to the REM mailing list.

Where it deems appropriate, the REM uses encryption or authentication tools, or both, as well as other methods to protect certain personal information derived from the Web and stored on its server. The visitor acknowledges and accepts that emails sent to the REM may be tampered with before reaching the REM server.

Personal, electronic or other information collected by the REM may be disclosed to Representatives who need such information to discharge a duty associated with the fulfillment of the purposes set out in this Policy. The visitor agrees and acknowledges that the REM is also authorized to use, disclose or provide the personal information of the visitor to the extent provided or required by law, including under court orders. 

To collect and analyze certain information, the REM uses Google Analytics tools on the Site. The demographic and interest reporting features provide access to anonymous statistical data about the gender, age, and interests of Site visitors in order to present them with useful content. This information is collected through the visitor's Google Account advertising preferences in a non-personally identifiable format. Other considerations

Definitions

For the purposes of this notice, the term Representatives includes the REM, its affiliates, shareholders, directors, officers, employees, agents and suppliers. For the purposes of this notice, the word Visitor means the person who, in fact, browses the Site as well as the person who authorizes the use of the computer or, as the case may be, the browsing equipment.

Entire agreement

The Policy covers the entire agreement between the Visitor and the REM regarding REM's processing and use of the Visitor's personal information, and supersedes the prior written or verbal agreements between the Visitor and the REM with regard to the subject matter hereof.

Interpretation

In the event of discrepancy between the two (2) versions of the Policy, the French version takes precedence. The masculine gender is used for easy reading purposes and includes the feminine.

Applicable law

This Policy is governed by the laws of the Province of Québec, Canada. The Visitor recognizes the exclusive jurisdiction and competency of the courts of Québec, Canada, in the event of any dispute related to this Policy.

Specific rules

In the event of discrepancy between one of the rules set out in the Policy and a specific rule set out on a page of the Site in relation to particular personal information, the specific rule shall take precedence. All rights reserved to REM.
